Per our contract with Orange County Mansions, LLC (formerly Estate Rental Network - ERN), it states the Security Deposit as follows: "30 days prior to event date RENTER shall provide to ERN a REFUNDABLE security deposit of $5,000 to be held as a general damage deposit. Deposit will be refunded 7 business days upon checkout after inspection. Damages will be documented and deducted from security deposit. Should the premises be left in good condition, RENTER'S deposit will be returned in full at that time." On October 17, 2010, Gonzalo Daza (groundskeeper) did the walk through with me of the premises, verified that all property was in good standing, and confirmed that a full deposit should be returned. He contacted his superior and owner of the Monaco Mansion Mr. Chuck Horning to inform him that his property was in proper condition and to notify you Mr. Robert Eid (Owner of Orange County Mansions and also know as Andrew Leon) to return the full deposit amount. Which means that on October 26, 2010 (7 business days after the checkout), my deposit of $5,000 should have been returned in full. That was not the case. On October 28, I called your general business line and spoke with you directly. You mentioned that the check would be received early the following week. On Tuesday November 2, I emailed you once again inquiring about the deposit, only to hear from you on November 3, that the check is in the mail and I should be in receipt of it by the end of the week. On Monday November 8, I emailed you again inquiring about my deposit check and received no response. On Tuesday November 9, I finally received a deposit check in the amount of $1,110 along with a handwritten note for additional "charges and services." You wrote the following: Deposit 5K Add on plate 13" clr gold bea 230 x 5.96/plate = <1370> Add on 4 hours open premium bar 3.50/person x 4 hrs = <3220> Credit <700> ____________ Refund 1110 At no point were any costs for those items put into our contract, included as an addendum, or verbally spoken to us. Liz Gilbert, a contracted representative of Orange County Mansions LLC / ERN and our "wedding coordinator" had never shown us an additional price up-charge for those gold plates from you AND at our rehearsal (in front of other witnesses) verbally informed us that it would only cost $700 to have the bar open for an additional 4 hours. Taking her word for that, we provided her with $700 cash that night for an open bar. My complaint here Mr. Eid / Mr. Leon, is that the "security deposit" was specifically drawn out in the contract for damages done to the property only, not for additional charges that were loosely and not explained by Orange County Mansions, LLC / ERN. We left the property in acceptable condition which was approved by Mr. Horning and Gonzalo Daza. Therefore the remaining amount of $3,890 needs be returned to me immediately per contract. These additional charges are not our responsibility since it was never disclosed prior to the event. This is a breach of our original contract. Including additional costs 1 month after the event, for items already covered in contract is wrong and illegal. A small claims has been filed against Robbie Eid, Andrew Leon, and Liz Gilbert.
